Discrimination In Employment

Discrimination of human beings has always existed throughout society, and most probably will always continue in this fashion. For centuries people have been discriminating others and have been discriminated against for factors that they are powerless to prevent, such as their skin colour, sexuality or gender.However, with a new multi-cultural society being created, race has now become the principal form of discrimination throughout the world. Making it the primary source of discrimination within multi-cultural companies and thus the employment sector, due to the high number of different races being present. To tackle this situation numerous steps have been taken within the political setting to stamp out discrimination within employment.The main federal laws in place prohibiting employment discrimination, more noticeably recognised as the Federal Equal Employment Opportunity (EEO) Laws, are; Title VII of the Civil Rights Act of 1964 (Title VII), which prohibits employment discriminati on based on race, colour, religion, sex, or national origin; the Equal Pay Act of 1963 (EPA), which protects men and women who perform substantially equal work in the same establishment from sex-based wage discrimination; the Age Discrimination in Employment Act of 1967 (ADEA), which protects individuals who are 40 years of age or older; Title I and Title V of the Americans with Disabilities Act of 1990 (ADA), which prohibit employment discrimination against qualified individuals with disabilities in the private sector, and in state and local governments; Sections 501 and 505 of the Rehabilitation Act of 1973, which prohibit discrimination against qualified individuals with disabilities who work in the federal government; and the Civil Rights Act of 1991, which, among other things, provides monetary damages in cases of intentional employment discrimination (EEO). DISCRIMINATION IN EMPLOYMENT Page#2 The U. S.Equal Employment Opportunity Commission (EEOC) enforces these laws and is op en for interaction with any citizen residing within the United States of America. Meaning that any individual is able to legally file a complaint or lawsuit against a company, if they believe that a company has broken one of these laws against them. Title VII prohibits not only intentional discrimination, but also practices that have the effect of discriminating against individuals because of their race, colour, national origin, religion, or sex; and therefore it is illegal to discriminate against an individual because of birthplace, ancestry, culture, or linguistic characteristics common to a specific ethnic group.This is the premier law that racial discrimination lawsuits base their foundation upon, as the actions of the employer to the employee illegally contradict the law’s principals. The Civil Rights Act of 1964 states that it is unlawful to discriminate against any employee or applicant because of their race, and that it is unlawful in regard to hiring, termination, co mpensation, assignment, or classification of employees; transfer, promotion, layoff, or recall; job advertisements; recruitment; testing; use of company facilities; training and apprenticeship programs; fringe benefits; pay, retirement plans, and disability leave; or any other condition within the realm of employment (VII).This therefore requires employers to provide equal employment opportunities to individuals, no matter what their race, colour or creed. However, if a promotion request of a Caucasian male within a company is accepted, whilst the request of an Asian male is rejected, the reasoning for this could easily be seen as racial discrimination against the Asian male. Allowing him to legally attempt to prosecute the company on grounds of unlawful practise, despite if the intentions of the employer were actually innocent. This situation was the case for small Solicitors firm where an Asian male successfully sued the company for over $3,000, as he believed he was rejected for promotion upon racial grounds.The firm was a dominant Caucasian enterprise within an area known for racial tension, between the Asian and DISCRIMINATION IN EMPLOYMENT Page#3 Caucasian communities. The employer stated that he believed the Caucasian male was more suited to the position, despite the Asian male having greater experience and more relevant qualifications. In October of 2005, Judge Sir Peter Irwin Casewell, ruled in favour of the Asian male, as he believed that racial discrimination had occurred and that employment laws had been breached. He ordered that the manager of the company, Mr. Edward K. Turrent, was to pay a sum of $3,200 in compensational damages to Mr.Aafiya Mumbtaz, for racial discrimination against the employee, hindering the progress of the individual’s career prospects, and disrespecting the employment laws set in place by the Civil Rights Act of 1964, Title VII (2&3). Due to the company being located within a racially charged area. I can fully unders tand the reasoning why the Asian male may feel repressed, and that the effecting variables were due to racial discrimination. Therefore I can understand why the company was suspected of breaking the civil rights act, as they refused promotion of a man of a different race, yet accepted a man of a their own creed, a breach of employment regulation.However, I do not believe that this incident was sufficient enough to award the â€Å"victim† over $3,000, as there is also the highly likely possibility that the company was acting accordingly. With the event occurring within a racially charged area, there is even the possibility that the Asian male was acting out of racial discrimination himself. Enforcing his revenge upon the Caucasian dominated firm, as he may be a racist individual, attempting to affect the business controlled by an opposite race. An additional reason why I would not have taken such drastic action is due to the fact that the Solicitors firm, whose workforce was a mere 12, employed the Asian male knowing that he was of a different race.If the company had practised racial discrimination, surely they would have rejected Mr. Mumbtaz upon application of the position, rather than reject his request for a promotion. DISCRIMINATION IN EMPLOYMENT Page#4 This to me shows evidence that a racist management did not control the firm, and therefore no racial discrimination within the business took place. Upon a more global scale, Apple Computers have recently been charged with a $40 million racial discrimination lawsuit, charging the company of unfair dismissal an African-American employee. Described by the plaintiff's attorney as â€Å"one the largest racial discrimination cases in U. S.history,† the suit alleges that the former employee was denied promotions and standard perks, isolated from co-workers; and then fired for a trivial offence. The suit was filed on October 30th in Santa Clara County Superior Court. The plaintiff, who did not reveal his name because he is currently looking for work, was an Apple employee from 1998 until he was fired in July 2005, working as a product design engineer. The lawsuit alleges that the plaintiff was fired after he brought a friend to work in April 2005, to encourage him to pursue a college education. Waukeen Q. McCoy, the plaintiff's attorney, stated that he believes his client has an exceptionally strong case for discrimination and wrongful termination.â€Å"His white counterparts have not been disciplined or terminated for bringing a friend or family member to campus, and it is a way for them to get him out of the company,† McCoy stated. He also believed that the plaintiff was receiving less pay than his white counterparts, an act that would be breaking employment laws. After bringing the friend to Apple's campus, the plaintiff was suspended, leading the company to launch an investigation before terminating the employee; who is now still without employment, currently looking for work in Silicon Valley. McCoy said that the employee had no prior problems and had an â€Å"above average† work record. When new management took control of the plaintiff's department within the company, he was immediately moved into a separate cubicle away from the rest of his groupDISCRIMINATION IN EMPLOYMENT Page#5 for no apparent reason. This formed the foundations of the lawsuit as it provided a suspect indication of racial discrimination towards the employee. The attorney for this case, Waukeen Q. McCoy, has a track record for successfully prosecuting racial discrimination lawsuits. He was the lead plaintiff's attorney in the largest racial discrimination suit in U. S. history, the infamous â€Å"Carroll v. Interstate Brands Corporation† case. Interstate Brands, makers of Wonder Bread and other consumer foods, was sued by 15 African-American employees for refusing to hire and promote African-American employees.In August 2000, a jury awarded the plaintiffs $135 million, leading the case to be voted â€Å"Verdict of the Year† by Verdicts & Settlements Magazine. Waukeen Q. McCoy stated that he would be willing to settle the case if Apple made a reasonable offer. However this request has fallen upon deaf ears, as Apple have so far failed to respond to the letters that McCoy has sent. Waukeen Q. McCoy said to reporters â€Å"I think this is certainly something that corporate America should look at and think twice about doing to someone, singling them out like this,† whereas a spokesperson for Apple declined to comment on the case, citing a company policy of not discussing pending litigation (Apple).Unlike the previous case of the solicitors firm where I believe the employee was at fault, and discrimination was free from the employment sector, it is most likely that racial discrimination did indeed occur within the Apple firm. The United States of America has a tradition of African-American slavery; and due to this, racial discri mination is the main assumption as to why an African-American person should be sacked by a Caucasian company. However, with this conjecture comes the fact that it is also easy for an Africa-American male to claim that he was the victim of racial discrimination, as he knows the topic will receive a great deal of coverage, and put the company who he believes has offended him under significant pressure. The reasoning for this may be money driven, as they know DISCRIMINATION IN EMPLOYMENT Page#6that the company may agree upon an out of court settlement, protecting the company’s image and reputable status. Despite this, my opinion that racial discrimination was present is made almost certain by the accounts of the African-American being moved into a separate cubical for no apparent reason, and the fact that the African-American man was prosecuted for actions that his Caucasian counterparts were not. In doing this, I believe that the Apple firm has neglected the laws of the civil r ights movement by not cohering to the laws of pay, fringe benefits, and the usage of the company facilities; therefore using racial discrimination against there employee, and should consequently receive punishment for their actions.Unlike the previous lawsuit, the Apple Company has a large workforce and employment system. As a result, this means that they obviously employ a great deal more employees due to the high number of jobs available. This presents the possibility of employing African-American individuals out of necessity rather than out of preference. Holding prejudice and racial discrimination against the employee from his arrival to the organisation. Lawsuits such as this cannot so easily be assessed due to the nature of the event, as there is no actual evidence that whatever occurred originated from racially driven motives; consequently meaning that the case is therefore based upon opinions and beliefs.My personal outlook upon the term racism itself, the main factor of rac ial discrimination, is that it refers to beliefs or practices that differences exist between the genetics of various groups of human beings; and that these differences can be measured upon a scale of superior to inferior. This therefore presents the theory that one race is greater than the other, which is the outlook upon life I believe a racist person preaches. If a person believes that their race if superior to others, I do not think that they themselves should be judged against the law, due to the fact that it is there belief, only there actions. Thus the outcome of the Apple Computer court case and the majority of Discrimination withinDISCRIMINATION IN EMPLOYMENT Page#7 Employment lawsuits, mainly Racial Discrimination, are forced upon becoming based upon the issues of morals and ethics. Morality is a complex set of principles based on cultural, religious, and philosophical concepts and beliefs, by which an individual determines whether his or her actions are right or wrong. The se concepts and beliefs are often generalized and codified by a culture or group, and thus serve to regulate the behaviour of its members. Conformity to such codification may also be called morality, and the group may depend on widespread conformity to such codes for its continued existence.A moral may refer to a particular principle, usually as informal and a general summary with respect to a moral principle, as it is applied in a given human situation (Morals). I believe that this statement shows that racial discrimination is indeed a moral topic, due to each race having their own morals, and most probably there racial actions originating from their form of morality. However despite this racial discrimination lawsuits cannot be assessed using this theory of philosophy, as morals do not determine what is right or wrong in the aspects of society, only for the particular individual in question. Ethics however refer to standards of conduct that indicate how one should behave, based up on moral duties and virtues; which themselves are derived from the principles of right and wrong.In order to apply this definition to practical decision-making it is necessary to specify the nature of the moral obligations considered intrinsic to ethical behaviour. There are two aspects to ethics: the first involves the ability to discern right from wrong, good from evil, and propriety from impropriety; whilst the second involves the commitment to do what is right, good and proper (Ethics). Due to this, I believe that this statement can easily be applied to the events that occur within the cases of racial discrimination within employment; as what employers have done to employees may not break the employment laws directly, however they impede the ethical laws within human society. DISCRIMINATION IN EMPLOYMENT Page#8If the situation of the Asian male lawsuit involved members of the same race, with the outcome being the same, it is most likely that no action would have been taken. Howe ver, if the situation within Apple Computers had involved a Caucasian male instead of an African American male, and the case was still taken to court. The lawsuit would then have to be resolved via the means of morals, as none of the employment laws would have been breached. This therefore leads to the conclusion that discrimination within employment is that of an ethical matter rather than being based upon moral principles. From what has been presented it is evident that discrimination occurs within the employment sector, no matter where the company is located, its size or the recognition that it withholds.It is not something that can easily be seen or addressed, such as the punctuality of an employee, and even if it is noticed it is then even more complicated to have any action taken. Throughout the world there is employment; employees looking for work, and employers looking for employees. Due to this there will always be racially mixed companies and, as long as there are racial b oundaries, racial discrimination within employment. Despite fair employment practises being in place to prevent discrimination within employment, the outcome is usually blinded by the nature of the event. Human society itself should be able to prevent this discrimination, without the need of imposed laws or regulations within the workplace.

As of the time of the case, 2007, although IMAX was involved in three different industries, the case suggests that it was primarily in Photographic Equipment and Supplier industry primarily because about 51 per cent of its total revenue of IMAX was system sale. Therefore, the following analysis will focus on that industry. Bargaining Power of Suppliers Major suppliers of photographic equipment and supplier industry may include manufacturers producing relevant components of any kind of equipment, contractors making the complete equipment, and so forth. From my viewpoint, the suppliers’ bargaining power is low because of several reasons. First, along with the development of photographically relevant equipment, although the products firms provide are technically concentrated, there are certain standards recognized and adopted, such as film size of 35 mm or certain sizes of lens filter, in the industry. Therefore, the switching cost for their buyers is low. Second, photographic equipment and supplier industry is an important customer to its supplier group. Specifically, the usage of the products that the supplier group provides is limited to machinery or equipment in other industries. Besides, although there are few substitute products, which situation generally increases supplier group’s bargaining power, firms in photographic equipment and supplier industry still can easily find other manufacturers with lower cost. Bargaining Power of Buyers The buyer group of photographic equipment and supplier industry is enormous, ranging from B2B buyers like motion picture production firms to B2C buyers like customers who purchase digital single lens cameras. Considering the difference of consuming difference of buyers and following reasons, the bargaining power of buyers is medium. First, sales volume varies among different segments. For example, motion movie production studios or chain multiplexes may have high bargaining power because of high purchasing volumes; on the other hand, customers who go to Staple to purchase a copy machine have little or no bargaining power. Second, the products in photographic equipment and supplier industry are generally undifferentiated because of aforementioned regular standard existing, and therefore bargaining power increases. However, exception could be that once new products are launched with attracting feature and highly accepted by buyers, such as IMAX format, the bargaining power decreases. Moreover, because of the great scope of photographic equipment, switching cost varies extremely, taking the difference between cameras shooting in IMAX digital format and little digital cameras from all brands in the market as example. Besides, backward integrations are less likely to happen compared to forward integrations from supplier group. Threat of Substitute Products In photographic equipment and supplier industry, treat of substitute is low primarily because products from this industry has been evolving for decades and has become essential goods. For instance, copy machine, also provided from the industry, has become essential equipment in firms and institutions. Although the substitute products to this example could be pens and paper, few people really would do that for efficiency concern, and therefore the switching cost is high. Intensity of Rivalry Competition in photographic equipment and supplier industry is intense for reasons. Because of the specialized nature of the products, generally exist barrier is high for big companies like Cannon, Nikon, and Xerox, and those major competitors are highly committed to the industry by providing products with advanced technology and competing against each other intensively. Threat of Entry From my viewpoint, the threat of entry in the industry is medium. Take multi-business electronics suppliers such as Sony and Samsung as example, they supply various lines of products and compete against each other. Even photographic equipment is not their primary selling product, supported by strong capital and experienced R&D departments, those companies are able to enter photographic equipment and supplier industry and split a piece of market share, primarily because of their existing reputation from relevant electronics industry. To deal with new coming competitors, current suppliers are less likely to have continuous price cutting battles because of high fixed costs; instead, it is more likely to increase investments, like R&D, and product lines to keep market share in every targeted segment. An obvious example is that when Sony entered digital single lens camera market with cheaper price, other major suppliers like Nikon and Cannon did not cut price on existing premium products but expanded product lines to launch cheaper products competing directly to Sony. In short, the barrier is not so high for certain new competitors to come into the industry, but because of the intense reaction from existing players, the impact and threat new comings bring in is moderate. Competitive Advantages Advanced Technology One of the competitive advantages of IMAX and the most distinguishing characteristics that differentiate the company from its competitors is its advanced and unique technology that brings new formats, and other associated system equipment like screen and projector into the industry. The key element contributes to this advantage is that the company was committed to invest in R&D. In return, the company was granted many patents that would keep the company in a unique position and from direct competition in the industry. Products Quality Control and Relationship Another IMAX’s competitive advantage is its quality control of products and system implementation. With its distinguishing technology, IMAX had been implementing the system into multiple locations, including multiplexes and education institutions, and because of its strict quality control and maintenance service, the company could maintain good relationship with diverse customers. The agreement of theatrical system implementation and service is an advantage for IMX to generate revenue not only from one-time transactions but long term profit splitting. Brand image and Product Distribution Diversity IMAX has built a unique brand image both from hardware and software perspectives and that also remains the company competitive. First, people would recognize IMAX as a prestigious theatrical system supplier based on their experience from multiple locations. Especially when major multiplex brands and education institutions carry its system, it’s very likely that people would naturally feel IMAX credible. The consequence is beneficial for IMX to expand business later, such as entering home theater system market. From the software perspective, especially the company’s educational entertainment production, not only create revenue other than just from commercial production but catch the trend of increased consumption of educational entertainment. The situation help IMAX build up a unique brand image that its production is not only commercial but educational so that people would have more trust in the company’s future motion picture production. To sum up, although IMAX has several competitive advantages, not all of them will last for too long. For instance, competitors could match up with its advances technology by inventing other formats and once they are accepted by end consumers, it will become a big threat for the company; On the other hand, some advantages could last for a long time once IMAX take good care of them. For example, the brand image being as a well motion picture production supplier is one that can remain in consumers’ minds for a long time and that’s not what new competitors can achieve in a short time. Corporate Advantages From my viewpoint, IMAX has corporate advantages because of its diverse productions from equipment supplier, motion picture production, and distribution industry. However, the most important issue is how to leverage those segments to increase the company’s growth. Business & Resources  IMAX’s core business, photographic equipment and supplier, provides capabilities to enhance all its business. The company has created competitive advantages as mentioned and those advantages enhance the company’s business across industries. For instance, for its motion picture production business, all the films are shot in new IMAX formats, film or digital, by the equipment its own supplier segment produces, it reduce huge cost for format conversion compared to other films shot in different formats y other studios. Organization Because of the narrow scope of the business, coordination among different sectors in the organization is critical for IMX. For instance, the vertical integration of the business allows the company to share resources such as instant feedbacks for its R&D department from motion picture production sector. By sharing these experience and information, the company will have the ability to forecast and adapt to new opportunities shortly in the future for every sectors in its value chain. In short, IMAX’s corporate advantages come from its competitive advantages and vertical integration. Because its business is based on unique technology and coordinated the whole value chain, it is not easy for competitors to imitate and therefore time for its corporate advantages is expected to last. Recommendations Keep Diversity of Production To answer the question that if IMAX would lose its differentiation because of numerous Hollywood films, my recommendation is that IMAX should keep doing converting Hollywood films and at the same time producing educational films. One reason is that format conversion brings good revenue for IMAX and people would be able to tell the difference between Hollywood movies in IMAX format and its own production. On the other hand, IMAX should keep catching on the trend of the increasing consumption of educational entertainment, because the company has been building up a good image distributing films in educational institutions and such would also prevent the erosion of its brand image. Not Sold to Larger Studios  Another recommendation for IMAX is that it should not be sold to a larger studio, and the main reason is that IMAX has already created its own competitive and corporate advantages and they are not easy to imitate. What IMAX should do is properly exploiting its assets, both tangible and intangible. Although the company in motion picture production industry is small and face competitors like Pixar, it should still stay on the track catching the trend by coordination and support from its other business ectors. Expanding Market & Production Diversity IMAX’s new technology is standing in a niche market without sustainable growth. Even though the company is able to keep generate great revenue from equipment sales, saturation in USA will become an issue someday. To deal with that, IMAX has to make a short term strategy doing business in USA and expand to global market, because from Exhibit 11, we can see that films generated revenue approximately two tim es overseas more as those in USA. However, for long term strategy, IMAX has to find a way to expand its business in a slow-growing market. For instance, the company can expand its product lines into home theater system because the case indicates a high usage rate of DVD, and the system is still highly relevant equipment to the current product lines. By doing so, IMAX can benefit from creating potential revenue from new sources and from keeping its brand image as a innovating company in the equipment supplier industry.

The brand name Amul, sourced from the Sanskrit word Amoolya, means priceless. It was suggested by a quality control expert in Anand and it was chosen because it was a perfect acronym for Anand Milk Union Limited. The Amul revolution was started as awareness among the farmers. It grew and matured into a protest movement that was channeled towards economic prosperity Over five decades ago, the life of an average farmer in Kheda District was very much like that of his/her counterpart anywhere else in India. His/her income was derived almost entirely from seasonal crops. The income from milk buffaloes was undependable. Milk producers had to travel long distances to deliver milk to the only dairy, the Polson Dairy in Anand – often milk went sour, especially in the summer season, as producers had to physically carry milk in individual containers. Private traders and middlemen controlled the marketing and distribution system for the milk. These middlemen decided the prices and the off-take from the farmers by the season. As milk is perishable, farmers were compelled to sell it for whatever they were offered. Often, they had to sell cream and ghee at throw-away prices. In this situation, the private trader made a killing. Moreover, the government at that time had given monopoly rights to Polson Dairy, which was run by a person of Parsi descent, (around that time Polson was the most well known butter brand in the country) to collect milk from Anand and supply to Mumbai city in turn (about 400 kilometers away). Another problem farmers faced was that in winter the milk output of buffaloes doubled which caused prices to fall down even further. India ranked nowhere amongst milk producing countries in the world in 1946. Gradually, the realization dawned on the farmers with inspiration from then nationalist leaders Sardar Vallabhbhai Patel (who later became the first Home Minister of free India) and Morarji Desai (who later become the Prime Minister of India) and local farmer, freedom fighter and social worker Tribhovandas Patel, that the exploitation by the trader could be checked only if they marketed their milk themselves. Amul was the result of the realization that they could pool up their milk and work as a cooperative Setting up of Kaira District Co-operative Milk Producers' Union In the early 40’s, the main sources of earning for the farmers of Kaira district were farming and selling of milk. That time there was high demand for milk in Bombay. The main supplier of the milk was Polson dairy limited, which was a privately owned company and held monopoly over the supply of milk at Bombay from the Kaira district. This system leads to exploitation of poor and illiterates’ farmers by the private traders. The traders used to beside the prices of milk and the farmers were forced to accept it without uttering a single word. However, when the exploitation became intolerable, the farmers were frustrated. They collectively appealed to Sardar Vallabhbhai Patel, who was a leading activist in the freedom movement. Sardar Patel advised the farmers to sell the milk on their own by establishing a co-operative union, Instead of supplying milk to private traders. Sardar Patel sent the farmers to Shri Morarji Desai in order to gain his co-operation and help. Shri Desai held a meeting at Samarkha village near Anand, on 4th January 1946. He advised the farmers to form a society for collection of the milk. These village societies would collect the milk themselves and would decide the prices at which they can sell the milk. The district union was also form to collect the milk from such village co-operative societies and to sell them. It was also resolved that the Government should be asked to buy milk from the union. However, the govt. did not seem to help farmers by any means. It gave the negative response by turning down the demand for the milk. To respond to this action of govt. , the farmers of Kaira district went on a milk strike. For 15 whole days not a single drop of milk was sold to the traders. As a result the Bombay milk scheme was severely affected. The milk commissioner of Bombay then visited Anand to assess the situation. Having seemed the condition, he decided to fulfill the farmers demand. Thus their cooperative unions were forced at the village and district level to collect and sell milk on a cooperative basis, without the intervention of Government. Mr. Verghese Kurien showed main interest in establishing union who was supported by Shri Tribhuvandas Patel who lead the farmers in forming the Co-operative unions at the village level. The Kaira district milk producers union was thus established in ANAND and was registered formally on 14th December 1946. Since farmers sold all the milk in Anand through a co-operative union, it was commonly resolved to sell the milk under the brand name AMUL. At the initial stage only 250 liters of milk was collected everyday. But with the growing awareness of the benefits of the cooperativeness, the collection of milk increased. Today Amul collect 11 lakhs liters of milk everyday. Since milk was a perishable commodity it becomes difficult to preserve milk flora longer period. Besides when the milk was to be collected from the far places, there was a fear of spoiling of milk. To overcome this problem the union thought out to develop the chilling unit at various junctions, which would collect the milk and could chill it, so as to preserve it for a longer period. Thus, today Amul has more than 150 chilling centers in various villages. Milk is collected from almost 1073 societies. With the financial help from UNICEF, assistance from the govt. of New Zealand under the Colombo plan, of Rs. 50 millions for factory to manufacture milk powder and butter was planned. Setting Up of Gujarat Cooperative Milk Marketing Federation In 1954, Kaira District Co-operative Milk Producers’ Union built a plant to convert surplus milk produced in the cold seasons into milk powder and butter. In 1958, a plant to manufacture cheese and one to produce baby food were added. Subsequent years saw the addition of more plants to produce different products. In 1973, the milk societies/district level unions decided to set up a marketing agency to market their products. This agency was the Gujarat Cooperative Milk Marketing Federation (GCMMF). It was registered as a co-operative society on 9 July 1973 COMPANY PROFILE THE TASTE OF INDIA, AMUL comes from the Sanskrit word Amoolya, means priceless. It was suggested by a quality control expert in Anand and it was chosen because it was a perfect acronym for Anand Milk Union Limited. AMUL was formed under the dairy cooperative movement in India in 1946 The Amul Pattern has established itself as a uniquely appropriate model for rural development. Amul has spurred the White Revolution of India, which has made India the largest producer of milk and milk products in the world. It is also the world's biggest vegetarian cheese brand . The system succeeded mainly because it provides an assured market at remunerative prices for producers' milk besides acting as a channel to market the production enhancement package. What's more, it does not disturb the agro-system of the farmers. It also enables the consumer an access to high quality milk and milk products. Contrary to the traditional system, when the profit of the business was cornered by the middlemen, the system ensured that the profit goes to the participants for their socio-economic upliftment and common good. Looking back on the path traversed by Amul, the following features make it a pattern and model for emulation elsewhere. Amul has been able to: ? Produce an appropriate blend of the policy makers farmers board of management and the professionals: each group appreciating its rotes and limitations, ? Bring at the command of the rural milk producers the best of the technology and harness its fruit for betterment. ? Provide a support system to the milk producers without disturbing their agro-economic systems, ? Plough back the profits, by prudent use of men, material and machines, in the rural sector for the common good and betterment of the member producers and ? Even though, growing with time and on scale, it has remained with the smallest producer members. In that sense. Amul is an example par excellence, of an intervention for rural change. Organization structure It all started in December 1946 with a group of farmers keen to free themselves from intermediaries, gain access to markets and thereby ensure maximum returns for their efforts. Based in the village of Anand, the Kaira District Milk Cooperative Union (better known as Amul) expanded exponentially. It joined hands with other milk cooperatives, and the Gujarat network now covers 2. 12 million farmers, 10,411 village level milk collection centers and fourteen district level plants (unions) under the overall supervision of GCMMF. There are similar federations in other states. Right from the beginning, there was recognition that this initiative would directly benefit and transform small farmers and contribute to the development of society. Markets, then and even today, are primitive and poor in infrastructure. Amul and GCMMF acknowledged that development and growth could not be left to market forces and that proactive intervention was required. Two key requirements were identified. The first, that sustained growth for the long term would depend on matching supply and demand. It would need heavy investment in the simultaneous development of suppliers and consumers. Second, that effective management of the network and commercial viability would require professional managers and technocrats. To implement their vision while retaining their focus on farmers, a hierarchical network of cooperatives was developed, which today forms the robust supply chain behind GCMMF's endeavors. The vast and complex supply chain stretches from small suppliers to large fragmented markets. Management of this network is made more complex by the fact that GCMMF is directly responsible only for a small part of the chain, with a number of third party players (distributors, retailers and logistics support providers) playing large roles. Managing this supply chain efficiently is critical as GCMMF's competitive position is driven by low consumer prices supported by a low cost system. The Union looks after policy formulation, processing and marketing of milk, provision of technical inputs to enhance milk yield of animals, the artificial insemination service, veterinary care, better feeds and the like – all through the village societies. DISTRIBUTION CHANNEL Amul products are available in over 500,000 PLUS retail outlets across India through its network of over 3,500 distributors. There are 47 depots with dry and cold warehouses to buffer inventory of the entire range of products. GCMMF transacts on an advance demand draft basis from its wholesale dealers instead of the cheque system adopted by other major FMCG companies. This practice is consistent with GCMMF's philosophy of maintaining cash transactions throughout the supply chain and it also minimizes dumping. Wholesale dealers carry inventory that is just adequate to take care of the transit time from the branch warehouse to their premises. This just-in-time inventory strategy improves dealers' return on investment (ROI). All GCMMF branches engage in route scheduling and have dedicated vehicle operations Establishing best practices: A key source of competitive advantage has been the enterprise's ability to continuously implement best practices across all elements of the network: the federation, the unions, the village societies and the distribution channel. In developing these practices, the federation and the unions have adapted successful models from around the world. It could be the implementation of small group activities or quality circles at the federation. Or a TQM program at the unions. Or housekeeping and good accounting practices at the village society level. More important, the network has been able to regularly roll out improvement programs across to a large number of members and the implementation rate is consistently high. For example, every Friday, without fail, between 10. 00 a. m. and 11. 00 a. m. , all employees of GCMMF meet at the closest office, be it a department or a branch or a depot to discuss their various quality concerns. Each meeting has its pre-set format in terms of Purpose, Agenda and Limit (PAL) with a process check at the end to record how the meeting was conducted. Similar processes are in place at the village societies, the unions and even at the wholesaler and C agent levels as well. Examples of benefits from recent initiatives include reduction in transportation time from the depots to the wholesale dealers, improvement in ROI of wholesale dealers, implementation of Zero Stock Out through improved availability of products at depots and also the implementation of Just-in-Time in finance to reduce the float. Kaizens at the unions have helped improve the quality of milk in terms of acidity and sour milk. (Undertaken by multi-disciplined teams, Kaizens are highly focussed projects, reliant on a structured approach based on data gathering and analysis. ) For example, Sabar Union's records show a reduction from 2. 0% to 0. 5% in the amount of sour milk/curd received at the union. The most impressive aspect of this large-scale roll out is that improvement processes are turning the village societies into individual improvement centers. Supply Chain of Amul Consumers expect marketers to deliver products in the locations and forms they require. To meet expectations of such demanding consumers, alignments of our four Distribution Highways of Fresh, Chilled, Frozen and Ambient products were already made by introducing Project DIL. Subsequently, a major initiative was taken to enhance distribution network to smaller towns. About 1200 distributors in small towns across India were added during this initiative. Today about 3000 Distributors ensure availability of our products across India, whether it is in Leh or Lakshadweep, in Kutch or Arunachal. Simultaneously, to augment fresh milk distribution in various markets of India, approximately 1400 exclusive Milk Distributors have been inducted. ? AMUL has the largest cold chain network in India (i. e. 18000 refrigerators) as compared to any other company. The chemical components of milk are water, SNF and solids. Milk is very perishable product so it has to be consumed within 24 hours. In order to avoid wastage AMUL converts the milk in to SNF and milk solids by evaporating the water, which comprises up to 60-70% of milk contents. This is possible only if the distribution channel right from the producer to the consumer is well organized. It will be surprising to know that AMUL makes even the ‘Sarpanch’ to eat pizza i. e. it supplies pizzas even to rural market. ? Last year, theye divided the retail market into 14 specific segments to achieve further distribution efficiency. This year our focus was on inducting distributors having expertise in servicing such specific market segments. This initiative is yielding results by way of ensuring wider availability of our product range. ? The role of distributors in our business process has never been more diverse or more important, as it is today. As a matter of fact, we consider our Distributor to be the real â€Å"Marketing Manager† of our organization. To enhance business performance of our Distributors, a workshop on Marketing and Sales Management was designed in collaboration with a premier business school. The objective of the entire initiative was to upgrade the knowledge of our Distributors in terms of contemporary Business Management Practices, so that they can perform well not only as our business partner but also as Marketing Managers. During the year, 659 Distributors have undergone this programme in 39 locations. Cold Storage is an extremely essential component n the Federation’s distribution process. Unfortunately, availability of efficient cold storage facilities is grossly inadequate in our country. So far, about 7000 Distributors and other business partners have participated in this Amul Yatra. ? Over recent years, the Federation has successfully introduced new product lines. This year, in order to leverage their distribution network strengths, to optimize market supervision expenditures, to achieve increasing efficiency while keeping the distribution infrastructure lean, focused and productive, the Federation amalgamated its different distribution networks. Today, they operate an efficient distribution infrastructure consisting of 46 sales offices, catering to 3,000 distributors and five lac retailers. Almost every Federation stockist has visited Anand to participate in a unique programme called ‘Amul Yatra'. During this programme, stockists are exposed to the Federation Philosophy, the culture of Cooperation, as well as operational Systems and Processes. The Federation has also invited distributor's salesmen from all over the country to Anand for a training program focused on the Federation's philosophy and developing their selling skills. THE BUSINESS MODEL From the very beginnFng, in the early 1950s, AMUL adopted the network as the basic model for long-term growth. †¢ The network explicitly includes secondary services to the farmer-suppliers. †¢ Several of the entities in the network are organized as cooperatives linked in a hierarchical fashion. Customers: In comparison with developed economies, the market for dairy products in India is still in an evolutionary stage with tremendous potential for high value products such as ice cream, cheese etc. The distribution network, on the other hand, is quite reasonable with access to rural areas of the country. Traditional methods practiced in western economies are not adequate to realize the market potential and alternative approaches are necessary to tap this market. Suppliers: A majority of the suppliers are small or marginal farmers who are often illiterate, poor, and with liquidity problems as they lack direct access to financial institutions. Again, traditional market mechanisms are not adequate to assure sustenance and growth of these suppliers. Third Party Logistics Services: In addition to the weaknesses in the basic infrastructure, logistics and transportation services are typically not professionally managed, with little regard for quality and service. In addition to outbound logistics, GCMMF takes responsibility for coordinating with the distributors to assure adequate and timely supply of products. It also works with the Unions in determining product mix, product allocations and in developing production plans. The Unions, on the other hand, coordinate collection logistics and support services to the member-farmers. In what follows we elaborate on these aspects in more detail and provide a rationale for the model and strategies adopted by GCMMF. Simultaneous Development of Suppliers and Customers: From the very early stages of the formation of AMUL, the cooperative realized that sustained growth for the long-term was contingent on matching supply and demand. The member-suppliers were typically small and marginal farmers with severe liquidity problems, illiterate and untrained. AMUL and other cooperative Unions adopted a number of strategies to develop the supply of milk and assure steady growth. First, for the short term, the procurement prices were set so as to provide fair and reasonable return. Second, aware of the liquidity problems, cash payments for the milk supply was made with minimum of delay. This practice continues today with many village societies making payments upon the receipt of milk. For the long-term, the Unions followed a multi-pronged strategy of education and support. For example, only part of the surplus generated by the Unions is paid to the members in the form of dividends Managing Third Party Service Providers: Unions focused efforts on these activities and related technology development . The marketing efforts were assumed by GCMMF. All other activities were entrusted to third parties. These include logistics of milk collection, distribution of dairy products, sale of products through dealers and retail stores, some veterinary services etc. It is worth noting that a number of these third parties are not in the organized sector, and many are not professionally managed. Hence, while third parties perform the activities, the Unions and GCMMF have developed a number of mechanisms to retain control and assure quality and timely deliveries. This is particularly critical for a perishable product such as liquid milk. Coordination for Competitiveness Coordination is one of the key reasons for the success of operations involving such an extensive network of producers and distributors at GCMMF. Some interesting mechanisms exist for coordinating the supply chain at GCMMF. These mechanisms are: Inter-locking Control The objective for developing such an inter-locking control mechanism is to ensure that the interest of the farmer is always kept at the top of the agenda through its representatives who constitute the Boards of different entities that comprise the supply chain. This form of direct representation also ensures that professional managers and farmers work together as a team to strengthen the cooperative. This helps in coordinating decisions across different entities as well as speeding both the flow of information to the respective constituents and decisions. Coordination Agency: Unique Role of Federation Its objective is to ensure that all milk that the farmers produce gets sold in the market either as milk or as value added products and to ensure that milk is made available to an increasingly large sections of the society at affordable prices Supplier Enhancement and Network servicing Their objective is to ensure that producers get maximum benefit and to resolve all their problems. They manage the procurement of milk that comes via trucks & tankers from the VSs. They negotiate annual contracts with truckers, ensure availability of trucks for procurement, establish truck routes, monitor truck movement and prevent stealing of milk while it is being transported. Mean Street embodies the culture that comes with this location. In the film, the audience is subjected to getting to know characters who spend their time womanizing, hustling, fighting, and drinking. Centered on the struggles of four men in their mid-20's and all residents of Little Italy, who are working their way up the rungs of gangster culture, some are loan sharks, and some are just plain hoods. Tony (David Proval) is a big friendly guy who runs the neighborhood bar; Michael (Richard Romanus) is a small-time loan shark who tends to rip off Brooklyn adolescents. Johnny Boy (Robert De Niro) is an irresponsible hood who borrows money from loan sharks that he never intends to pay back, and Charlie (Harvey Keitel) is the nephew of the mafia boss Giovani (Cesar Danova). Charlie's only aspiration is to run his own restaurant. Mean Street is authentically based on specific events Scorsese saw almost regularly while he was brought up in Little Italy. The screenplay for the film initially started out as a continuation of Who's That Knocking. Scorsese changed the title from Season of the Witch to Mean Street. The film is arguably Scorsese's most religious film, even more so than his film The Last Temptation of Christ. This is in part due to the fact that the original draft of Mean Street centered on the religious conflict inside of Charlie and how it was affecting his world view. Charlie sees saving Johnny Boy as a way to find redemption. His aspirations for sainthood are played out through his behavior on the streets, as opposed to going to church. This is one of the implied meanings in the film. The implied meaning that comes with an auteur directed film is all present in Mean Street. In his article Senses of Cinema, Marc Raymond points out many of the film's intricacies. He argues that there is an implied homoeroticism between Johnny Boy and Charlie. Media and Masculinity Essay Penelitian ini bertujuan untuk memahami dan mendeskripsikan: (1) Konstruksi maskulinitas pada majalah laki-laki gaya hidup FHM. Tujuan tersebut dilengkapi dengan penjelasan realitas sosial yang melatarbelakangi hadirnya majalah laki-laki FHM (global dan lokal/Indonesia); (2) Konstruksi maskulinitas pembaca terkait dengan maskulinitas FHM. Penelitian ini menggunakan paradigma konstruktivis dengan kajian teoretis pada teori konstruksi sosial atas realitas (termasuk juga teori interaksionisme simbolik, dramaturgi dan semiotika), teori media massa dan konstruksi sosial, audiens dan pengkonstruksian makna, majalah laki-laki, dan teori-teori maskulinitas (jender). Penelitian dilakukan dengan menggunakan pendekatan kualitatif dengan menggunakan sasaran studi majalah FHM, pembaca FHM di kota Solo dan Yogya, reviu media (akses internet) serta buku-buku literatur. Reviu media serta buku-buku literatur tersebut dikaitkan dengan realitas sosial yang melatarbelakangi hadirnya majalah laki-laki gaya hidup secara umum di mana FHM merupakan salah satu diantaranya. Teknik sampling yang digunakan untuk studi majalah dan pembaca adalah purposive sampling. Untuk majalah, dilakukan dengan menggunakan teknik maximum variation terhadap rubrik-rubrik tetap yang menghadirkan maskulinitas yang kontradiktif dengan maskulinitas tradisional. Terbitan yang diperiksa adalah FHM edisi perdana (September 2003) s/d April 06. Hal ini dilakukan agar memperoleh gambaran variasi konstruksi maskulinitas yang secara konsisten disampaikan majalah melalui seluruh terbitannya. Setelah menemukan variasi maskulinitas tersebut peneliti membagi rubrik-rubrik tetap yang dimaksudkan ke dalam area-area maskulinitas yang mewakili mereka. Dalam masing-masing rubrik tetap, tidak  semua artikel yang ada sepanjang terbitan yang diteliti akan diambil. Tapi akan diambil artikel tertentu yang dianggap peneliti memiliki variasi ‘teks’ paling lengkap yang ditujukan untuk dapat membahas maskulinitas tertentu secara lebih komprehensif. Untuk pembaca dilakukan purposive sampling dengan kriteria pembaca yang membeli rutin majalah minimal telah membaca selama setahun serta masih berlangsung sampai dengan saat penelitian berlangsung. Pencarian pembaca ini dilakukan melalui milis fhmindonesia, agen-agen majalah dan informasi yang diperoleh dari teman. Pengumpulan data untuk studi majalah dilakukan dengan menggunakan teknik analisis media yaitu menggunakan analisis wacana yang difokuskan pada jender. Sementara itu pengumpulan data untuk studi pembaca dilakukan dengan menggunakan teknik wawancara mendalam dan pengamatan berperan pasif (observasi). Hasil-hasil penelitian dapat dikemukan sebagai berikut: (1) Studi terhadap majalah dan pembaca menunjukkan bahwa majalah laki-laki FHM menampilkan  progressive masculinity (androgyn). That is the masculinity which developes femininity. Yet this magazine still emphasizes the traditional masculinity. The finding which shows the masculinity proggressivity (androgyn) is: (a) Manly character â€Å"Metrosexual† (body image area); (b) â€Å"The equality pattern in the interpersonal relationship between man and women (interpersonal area); (c) The character â€Å"Emotional Man† (emotional area); (d) The character â€Å"FashionedTechno Masculinity† (intellectual area); (e) The character â€Å"Caring Man† in the sexual relationship affairs (sexual area); (f) The lost of man’s role as a breadwinner/a maker a living (functional area). The magazine presents the man’s image as â€Å"Single Blessedness Forever† owns a chance to wish of pleasure for himself and leads the exciting consumption activities; (g) The masculinity with the character â€Å"Social Butterfly† (pleasure area). The second, magazine’s masculinities is not a new issues at all for the readers, but it is already observed in the daily life (peer group, work surroundings, general society) and the socialization of the other media, so, refer to that explanations the magazine functions is empahasizing the masculinity. Eventhough the magazine offers the new masculinity or the progressive masculinity at the same time, which looks contradictive against the traditional masculinity (which has been normalized), the interaction between the readers and the magazine is dynamic, a competition between push and pull. Adults with learning disabilities comprise of a highly vulnerable part of the society, who have limited access to health care facilities /services offered to them. According to Kerr et al., (1996a) he states that, learning disabilities suffer form a similar range of morbidity as the general population, but some conditions are seen with greater frequency within certain syndrome. They are often faced with obstacles and challenges while coping with grave situations such as loss and bereavement of loved ones, personal illness, death etc (Elliott, 1995).They are known to have been ignored persistently in terms of providing services in the need of personal illness, death, and other challenging life situations, thus increasing their vulnerability all the more (Elliott, 1995). Vulnerability Risk: A vulnerable adult is a person who is eighteen years of age or older who is, or may be in need of community care services by reason of mental or other disability, age or illness; and who is or may be unable to take care of him or herself, or protect him or herself against significant harm or exploitation. -No Secrets March 2000, p 45. Every human being becomes vulnerable during their lifetime for many of reasons they all respond differently to events that happen to them because of who they are and the lack of support that they have around them (Jacki, 2001). The term vulnerable adult(s) is now use more widely in the social care field than it ever was, but it may be open to interpretation and being vulnerable means different things to different people (Jacki,2001). People with learning disabilities are one of the most vulnerable groups in the society (Department of Health 2001). Learning disabilities may be more at risk not only because their own difficulties in understanding or communication but also because of the way they receive services and the fact that they may be actively targeted or taken advantages (Jean and Anthea, 1997). The broad definition of vulnerable adults is a person: who is or may be in need of community care services by reason of mental or disability, age or illness; and who is or may be unable to take care of themselves, or unable to protect him against significant harm, risk or exploitation (DOH 2000, s.2.3). Among the most vulnerable members of society they cant speak up for themselves. For example, if consequences are limited when an adult with learning disabilities abuses another person, the victim may be left with the idea that such behaviour is normal and acceptable, and that services will provide little protection and that their complaints will not be heard. It may also increase their vulnerability to further abuse because abuse can become normalised and more likely to be the victim of abuse physically (McCarthy and Thompson, 1996). The Oxford Dictionary define risk as meaning a hazard, a dangerous, exposure to mischance or peril, as verb it also similar which means hazard, to danger, to expose to the chance of injury or loss( Parsloe, 2005). Risk is closely linked to dangerousness, resulting in harm which seems to be agreed means harm to self or others and extend of harm which constitutes a risk in various situations especially adult with learning disabilities. Definition of vulnerable adult in section 80(6) Care Standard Act 2000 states that- (a) an adult to whom nursing and accommodation or personal care are provided in care whom (b) in adult to whom personal care is provided in their under arrangements made by a domiciliary care agency own home (Peate Fearns, 2006). Adults with learning disabilities, and those people who have a less capacity like who have mental illness, old and frail, need protection from potentially abusive situation over which they might have little control (Department of Health, 2000). Learning disability Adolescents obliviously it is not always acted in ways that serve their own best interests, even as defined by them (Fischhoff et al., 2000). Sometimes their perception of their own risks, even of survival to adulthood, is larger than the reality; in other cases, they underestimate the risks of particular actions or behaviours since adults abuse and risk has gain higher profile. According to Robert (2009) Learning disability is a neurodevelopment disorder affecting a specific cognitive skill that occurs in the presence of intact skills in most others realms and specific impairments are presumed to be due to dysfunction of the brain and to have been present since birth. And learning disability substantially limits functioning in one or more aspect of persons life (Mapou, 2004). According to Mencap (2010) reports that, in the UK there are 1.5 million people with a learning disability. Most are treated as different and dont have the same control over their own lives as the rest of our society. Over the past century and a half there have been huge changes in the in the labelling of those people presently categorize as having learning disabilities. In social policy terms, they have been variously labelled as vagabonds, idiots, mentally handicapped, learning disabled, and people with learning difficulties among others names (Gordon,2005). Different periods in history have meant different things, depending on the social and economic circumstances of the time, and of course on how long people with learning disabilities lived (Brian, 2006). Risk Assessment Decision Making Process/ Practice Tools: Increasingly responding to the risks of others, preventing risks to vulnerable adults or running risks to themselves is all in days work for the busy practitioners and manager in the field of social care (Brearley, 1982). Every day a lot of risk situation changes rapidly and what applied yesterday but may not today. Those service users who are identified as at risk would be provided highly effective instruction to reduce their risk in the identified area (e.g., language, reading, numeracy/ math, behaviour) (Brown, 2003). To minimize risk and make it useful and meaningful, may risk situations need to be reassessed regularly perhaps daily basis according service users daily need. People with learning disabilities are subject to risk all time due to their vulnerability they sometimes abused by those who have control over them or by those who realize that they are vulnerable because of their disabilities they often find it very much more difficult to assess risk the way most of social carer and services do (Vaughn and Fuchs, 2003). While most of carer don dont asses risk very efficiently they generally make some attempt to do so. Its not easy at all to do risk assessment as it is a complex task and most of the time carer or support worker they do adequately but not very thoroughly (Carol, 2002). In spite of some difficulties, there is an increasing awareness that people with learning disabilities can make choices, moreover they want to do so. Nevertheless its often failed to consider is that, the amount of risk that these choices carry and most of us have grown up accustomed to risk-taking. Many problems about assessing risk that different services user may perceive the different risk. What is acceptable to one person may not be acceptable to another. Main objective of the risk assessment when its possible may sometimes affect decision making in number of different ways (Heilbrun, K.et.al (1999). It is true many adults with learning disabilities who have always facing risk in their everyday life. Significantly about choice decision sometimes its difficult for adult as well carer to make right choice how could be at risk. The difficulty for people with learning disabilities is that carers often do feel often they are expected to make these choices for them. The law of negligence can appear to inhibit decision making personal freedom and choice sit uncomfortably next to the concepts of duty of care and professional liability (Fuchs, 2003). People with learning disabilities may not have done perhaps carers need to be encouraged to help their service users how to make choices with and appreciation of the risk involved. This is more challenging task than just encouraging choice alone it seems that not only should people with learning be allowed to make choices and take risk they should actively be encourage to do (Kemshall Pritchard, 1996). Multidisciplinary Risk Assessment: There are a range of sources where information can be gained for a through risk assessment which include the prospective resident, their relatives or practitioners involve with the person and any written reports; which may be historic or recent (Alaszewski and Manthorpe, 2002). The problem with the right to make choices is that it assumes that adult with learning disabilities are able to make choice about risk in the same way every one does (Heilbrun, K.et.al.1999). It acknowledge that adult with learning disabilities do have real difficulties with many cognitive takes. Most have problems in assessing risk effectively because of the complexity of doing so it is likely that people with learning disabilities will find the particular difficult. It could be helpful when any risk assessment plan to do like-if carer support worker want to take any decision about the service users or any person , is the person are aware about that decision been mad or going take ? Are they communicating their choice decision making? Giving more choice people with learning disabilities especially about taking risk, its mean that carer have to be alert to the extent to which the service users are able realistically to assess the level of risks involved (Sellars, 2003). Many adult with learning disabled the most successful way to avoid and minimize risk to avoid further problem is by effective management. When the person concerned may have been living in a setting where the opportunities for such behaviour have been very limited or absent, carers and professionals are sometimes tempted to assume that because the recent past has been incident-free the problem has disappeared (Carol, 2003) Risk Assessment: Risk assessment is about predicting the future and the likelihood of particular events occurring; these will be both wanted and unwanted events (Pritchard, 2004). Risk assessment is merely the description of good methodical practice to risky situations (Jones, 1998 p.5). In leave to address matters of importance for instance dangers, hazards, and known triggers and how best to keep away from them is a risk assessment. Confirm that they are recognizable with the exacting risks that you have put measures in place to reduce, or eliminate them and that you could face with the person in your care. A multifaceted and time consuming task and a continuous process is Assessment (Pritchard, 1997). Assessment of risk for adult with learning disabilities which should be evolutionary in nature constantly informed and shaped by changes of circumstances upon service users needs (Brown, 2003). The practice of risk assessment and management is the process of data collection, recording, interpretation, communication and implementation of risk reduction plan (Maden, 1996). For the risk of learning disability, clinical model of risk assessment have become the norm. There are two kinds of risk that are relevant to work people with learning disabilities, risk of unnecessary exposure to undesirable events or experience, and risk of negative consequences when possible benefits and desirable experiences are perused ( William, 2006). Above this it is clear that a strategy of prevention should implement, and management is required so that risk and benefit are balanced. In social care and health care there are broadly two main context of risk which are not provided and everyday risk in their life and learning disability have a history of formally documented offence (Thompson, 2000). So far it has been established that different service users have different risk upon their physical and mental health which is major issue for people with learning disabilities and there are large number of people with learning disabilities who suffer from variety of physical and mental health condition (Heilbrun, K.et.al. 1999). However, the true extent of the problem cannot be known, due to difficulties in assessment, and it is estimated that the actual number is high due to the service users being unable to sufficiently communicate their social life. It follow that the more severe the communication problems, sometime its difficult service user are gain true assessment (Priest Gibbs2004). In order to fully appreciate the process of risk assessment, here identify the one of particular service users and consider the kind of life they lead at present. Service users who is Mr M 22 years old young male with complex physical learning disabilities who has Cerebral palsy affecting all four limbs, epilepsy, severe learning difficulties and Migraine which affects him seizure pattern. Who lives in a residential care home with four others service users people with learning disability. However this service user also have gastro feed which need to use for his water and medication as he cant drink and always need someone to assist his food. Deliberate self-harm is relatively common when he feels unhappy and anxiety his verbal language is very limited he can communicate within short sentences and can answer yes/no. Mr M always need to use wheel chair for maintains his everyday life. Assessment of risk The plan should note risk low, medium or high as well as the impact of the child or young person on others. (Guidance on the Child or Young Persons Plan, Scottish Executive. 2007, page 13). Risk assessment is useless unless the results are shared with everyone who is involved in the care of ht client (Sellars, 2003 p.154). There are several risk exist her for this service users as he has Cerebral palsy which is a general term used by doctors to refer to a set of neurological conditions that affect a people movement and co-ordination. Neurological conditions affect the brain and nervous system. Epilepsy is common, he needs to regular medicine and to control this and possibly refer to regular doctor visit due to he has migraine problem as well as. He also has choking difficulties while he eats his meal. Risk can fall of wheel chair if it does not fasten. At risk of being hurt when moved. And at risk of falling off ramp when loading in to resident vehicle while he travelling. Risk to carer/staff: This service user often to risk carer or staff, some risk that he could become aggressive if he is feel hungry or any physical illness. Infrequently he can become aggressive or even violent during the illness so that this behaviour needs to be monitored. Frequency of risk: This service user sometimes settled and had good responded well to medication. It is likely he is vulnerable and sometime faced with stress in his life due his migraine problem. And he has Percutaneous Endoscopic Gastrostomy (PEG) and need to see doctor every four months. Level of Risk: The level of risk is very high this residential care home has own risk assessment plan. For minimize the risk as vulnerable adult trust has their own policy according to service users need. For health and safety and others physical risks as well as there are recognized health risk associated with the carer and service users. Taking risks daily on occasion, and thus the level of risk that he will come to harm which is quite high. Manual handling risk: To minimize risk during changing of position in bed/on floor, slide sheet to be used and make sure service user is positioned correctly and two trained staff to assist him all times. Staff to use high adjustments on equipment where needed like Hoist. To transfer from bed to chair, chair to bed and chair to chair the level of risk also high staff always hoisted for all transfer using allocated sling. Staff to use height adjustment equipment where available during Changing Bench/ shower/ bath level of risk also high. Due to his physical ability while he travels in transport he need his wheel chair and have to make sure four point clamps to be use while on the vehicle and addition seat belt to minimize risk during his journey. Possible outcome: The immediate outcome is that health needs are constantly monitored by his parents and his career. He has cerebrally palsy which affecting his limbs and also had severe learning disability and epilepsy which is controlled using prescribed medicine that administrated by his concern of his resident/trust. He also sometimes suffers from migraine and takes medication for his migraines appears to be controlled at the present time. He always uses wheel chair for mobility. Seizure and migraines are prone to increase when become too warm and carers are aware of this which is monitor by closely. Managing Risk: From the above analysis it is clear that this service user is a high risk client. However, the key to understanding the level of risk is the acceptance that his behaviour could be change which depends on his medication and close support from his parents/ career and doctor. And it is important in the first instance try keep staff safe and would be wise to ensure that staff work always in pairs, and that vulnerable are not left alone unattended. While assessed others should not be put at risk and violence cant be ignored (Casellas, 2003). Sometimes it would be wise to monitor behaviour it may be possible to discover patterns his behaviour like- When he became agitated is there any time or reason? How about his voice does he react different tones of voice? Why he wants to hit staff is there any communication gape? Are some time or someday difficult? Does he feel uncomfortable or need personal support? Or are there any physical problems which make him unhappy and annoyed? For behaviour assessment by psychologist or doctors recommended, in order to see if any patterns emerge this may allow the behaviour plan to be managed within the existing home. However sometime service users simply exploiting inexperience staff to his advantage, then it may be necessary to move him to another place ensuring that he is supported by staff with experience who knows him well. Thus a review of medication and careful monitoring to ensure that he takes it may improve the situation which he has epilepsy and others physical illness. And staff should be aware environment they are in and hazard that may be present. While proper risk-assessment procedures may be lengthy and complex quality of life for a person with learning disabilities is likely to depend upon them (Kemshall and Pritchard 1996). Conclusion/Recommendation: Risks change constantly and people grow, change, and develop. It is important to review risk assessment regularly, and aim always to increase choice and freedom for the people with learning disability (Sellars, 2003 p.155). People with learning disabilities are beginning to reclaim the lives they lost in the institutions, having choices, jobs, sex lives and even becoming parents unthinkable until even quite recently. Slowly, perhaps far too slowly, the rest of the community is beginning to realize that the majority of people with learning disabilities are not so different from everyone else, and need the same things in their lives that all of us do: work, leisure, partners, and a sense of being part of a social group (Heillbrun, K. Et al 1999). They want to feel useful and valued, as we all do. Life is full of risks. We all take risks all the time, and the more familiar they are the less we tend to recognize the real level of risk involved. It actually takes the greatest risk in our lives every time that we step into a car, but few of us really consider that risk seriously (Daniel, 2003). This is the other side of the coin; we are inclined to believe that it wont happen, even when the objective statistics suggest otherwise the difficulty that now exists for people with learning disabilities, especially those with greater disability, and those who care for and support them, is that the law specifies that many such people are vulnerable, and not able to make this choice for themselves (Daniel, 2003). The onus of assessing risk and making the decision therefore often rests with carers. Because it is such a difficult decision to make for someone else, carers often take the simple way out, and avoid letting situations arise where learning-disabled people in their care have the opportunity to develop sexual relationships: if a person cannot make an informed choice then perhaps it is easier not to offer them that choice (Lindsay 2004). This is the current dilemma for those who work in community care situations. According to David J. Thompson,(2000) the issue of sexual relationships is perhaps the most difficult and complex, but this problem of balancing risk and choice is a constant one for carers and professionals, in relation to many aspects of everyday life. In the background is the ogre of the law (and/or local management), ready to jump on the unwary, should they get it wrong. No wonder, perhaps that many are cautious about enabling such choices to be made. Get higher in the information of vulnerable adults referred to them for the reason that they are at risk of physical and sexual mistreatment, in addition to financial fraud, a study has found in Social services departments have seen (Simon, 1997. So where adult with learning disabilities have more complex problems, such as behaviour problem, mental illness, or others any physical or mental disorder they will need additional care and support to cope with their everyday lives (Hawks, 1998). Sometimes these problems impose additional risks, and these do need to taken into account when assessing and managing risks for each person/adult.
